ActionSA Demands Repayment of Unlawful Knysna Municipality Salaries

Following a High Court judgment of 07 June 2023, which found that the ANC-led Knysna Municipal Council’s resolutions that Londiwe Sotshede be appointed as Acting Chief Financial Officer and that Luvuyo Loliwe be appointed as Acting Director of Corporate Services were “unlawful, ultra vires and null and void”, ActionSA has written to the Municipal Manager of Knysna Municipality, demanding confirmation that no salaries will be paid to either Sotshede or Loliwe in the future, and particularly not on the next ordinary payday on 25 June 2023.

ActionSA is concerned that, despite Sotshede and Loliwe having left office, they will still receive their salaries.

ActionSA has also demanded confirmation from the Municipal Manager that Knysna Municipality will be taking the necessary steps to recover the remuneration already paid to Sotshede from 14 February 2023 and that was paid to Loliwe from 15 March 2023.

Should the Knysna Municipal Manager fail to provide this confirmation by close of business on Monday 19 June 2023, ActionSA will approach the High Court on an urgent basis for an interdict preventing these salaries from being paid, and seeking an order from the High Court that steps be taken for the remuneration already paid in respect of these unlawful appointments to be recovered.
