ActionSA Implores New Public Protector to Acquit Herself with Distinction & Rescue the Office from the Shambles Left by Mkhwebane

ActionSA notes with cautious optimism the appointment of Advocate Kholeka Gcaleka as the Public Protector. She appears to be qualified for the role.

This comes after a protracted period when Busisiwe Mkhwebane was in charge and made considerable efforts to undermine and discredit the authority of this important agency that supports constitutional democracy in blind service to a nefarious political agenda.

While we believe the Adv Gcaleka is qualified to perform the functions demanded by the office, we are, however, concerned that she might be partisan considering her whitewashing of the Phala Phala scandal just a few months ago. We urge Adv Gcaleka to not fall into the same quicksand that her predecessor succumb to in her 7-year reign at the Chapter 9.

The Office of the Public Protector was established as an independent body that ensures that the rule of law is maintained and that those guilty of abusing resources and state power are held accountable.

Nevertheless, we look forward to her discharging her mandate with distinction and ensuring that the office fulfils its duty of being the voice of the people and acting with autonomy.

The country is in desperate need of a public protector who would affirm the independence the office once bore, restore its integrity, and put an end to the corruption that has characterised our dear South Africa.

We, as ActionSA, believe that there should be zero tolerance for corruption. Preventive and prosecution measures should be implemented to hold all public representatives and servants accountable.

Furthermore, we promote the amendment of the Constitution to create an independent Chapter 9 anti-corruption agency with expertise in dealing with corruption and independence from political influence and interference to enable it to act without fear, favour, or prejudice.

The office of the Public Protector should be a symbol of our democracy and an institution that handles all misconduct and corruption accordingly.
