ActionSA has written to the office of the City of Johannesburg Speaker, Margaret Arnolds, to ascertain the basis that prompted the re-appointment of the City’s Ombudsman, Advocate Siduduzo Gumede.
Advocate Gumede was suspended on May 9, 2017 for “gross dereliction of duties, alternatively negligence, and alternatively failure to act in the best interest of the Office of the Ombudsman and/or the City for failing to ensure that a service agreement between the city and Yeo Technologies (Pty) Ltd was signed prior to the company providing services to the office of the ombudsman.”
Advocate Gumede was further compelled to justify why “he failed to invoke clause 10 of the agreement, that is, the penalties clause in terms of which penalties could be imposed” and why he failed to “request or ensure the extension of the agreement or procurement of an alternative solution timeously” when the contract with the service provider lapsed.
An extra charge was also added for bringing “the office of the Executive Mayor and/or the City of Joburg into disrepute in his engagements with the media.”
ActionSA believes that the allegations against Advocate Gumede were not properly ventilated and must be tested again in court.
ActionSA has therefore requested access to the minutes of the council sitting that led to the resolution to reinstate Advocate Gumede, in contradiction of the serious nature of the allegations against him. It is of paramount importance to comprehend the rationale behind the decision to reappoint him.
We believe that transparency and accountability are paramount to upholding the trust of the citizens in the council’s decisions.
The ruling party has a tendency of rewarding mediocre individuals with crucial roles within the City entities through their cadre deployment policy. As a party rooted in the rule of law, we are going to zoom into this matter until we get satisfactory answers.
