ActionSA to Take Legal Action Against Ugu District Municipality & Provincial Government

Last week, we were honoured to have our National Chairperson and #TeamFixSA member for Infrastructure, Michael Beaumont, join us during our community engagement meeting in Port Edward.

The primary objective of this gathering was to gain valuable insight into the countless challenges faced by the residents of Port Edward, particularly under the governance of the ANC-led Ugu District Municipality.

Throughout the meeting, various issues were brought to our attention, reflecting the hardships endured by the community. Among these challenges, one significant concern repeatedly emerged, which is the lack of access to clean and drinkable water.

The Ugu District Municipality’s failure to provide clean, drinkable water to the community of Port Edward for the past 3 to 9 years represents a severe violation of their basic constitutional rights. Access to clean water is not just a necessity but a fundamental human right outlined in the South African Constitution.

The neglect of this essential service has subjected the residents of Port Edward to unacceptable living conditions and health risks. The lack of access to clean water compromises their well-being, undermines their dignity.

Despite repeated appeals and community engagements, the Ugu District Municipality and provincial government has failed to fulfil its obligation to  water infrastructure and to the people of Port Edward.

Last year, the South African Human Rights Commission (SAHRC) released a water inquiry report, which exposed concerning realities about water accessibility in the province. The distressing challenges encountered by residents of the Ugu District are particularly disturbing.

The report goes on to highlight that the residents of the District believe that Municipal officials are in denial of the water crises,

Also highlighting that a home for the elderly and orphans has made attempts since 2017 with the Municipality to address this crisis as it has left them unable to fulfil their services, however, promises were made by officials to provide water tankers, but the promises were never fulfilled.

One of the key issues that were outlined by the SAHRC is the lack of accountability in performances by municipality in giving effect to their constitutional obligations to bring access to clean running water to community members.

The District Municipality has failed to repair and renew aging infrastructure over the years.

This negligence demonstrates a disregard for the constitutional rights of the community and highlights the urgent need for accountability.

Therefore, as a party that strongly believes in the rule of law, we are currently in talks with our legal representatives to take legal actions against the District Municipality and the provincial government to compel them to fulfil their constitutional obligation to bring clean water to this community.

We are also calling on all professionals such as water experts and engineers to join our team of experts and legal team in this matter as we spearhead our litigation against the Ugu District and the provincial government.
