ActionSA is pleased that the National Prosecuting Authority Act has been signed, and the accompanying regulations have finally been gazetted, marking a significant milestone that now empowers the NPA’s Investigative Directorate (ID) to function with the full authority and resources required to execute its mandate effectively.
ActionSA wrote to President Ramaphosa on 15 August, raising our alarm that the Investigative Directorate (ID) has been essentially kneecapped, as evidenced by the fact that the necessary regulations had not been gazetted, despite the NPA Act being assented to earlier this year, and by the Department of Justice’s failure to address concerns regarding the ID’s inability to access critical state capture evidence, despite nearly 20 letters.
In response to our letter, the President’s office acknowledged that the issues regarding the state capture evidence database are being attended to and that the necessary regulations, as of 19 August, have been gazetted, thereby ensuring that the Investigative Directorate (ID) is permanently established and empowered to operate effectively.
Importantly, we hope that the ID’s permanent designation and capacitation will enable the NPA to hold those responsible for State Capture to account. For too long, South Africans have witnessed the devastation wrought by corruption and the erosion of public trust and with the ID now fully empowered, there is a renewed opportunity to bring to justice those who have plundered the nation’s resources.
ActionSA is determined to use every parliamentary lever and institution to ensure that progress is made in swiftly charging and prosecuting those guilty of State Capture for their treasonous actions.
