ActionSA in the Western Cape has written to the Knysna Municipal Manager requesting him to take steps to recover unlawful remuneration paid to Acting Chief Financial Officer, Londiwe Sotshede and Acting Director: Corporate Services, Luvuyo Loliwe.
Not only were the re-appointments of these Knysna Municipal officials declared “unlawful, ultra vires and null and void” by the High Court, but the Knysna Council’s decision to appoint them at the maximum scale was also unlawful due to Sotshede not having the required qualifications and Loliwe not having the required experience.
South Africa is being held back by unethical leadership and unqualified public servants. We must act as one to build a dynamic, efficient and citizen-orientated public service that serves the interests of the South African people, not politicians and officials. We cannot stand by when appointments are made unlawfully and when large salaries are paid to officials who are not qualified to receive them.
ActionSA, last week, attempted to obtain an undertaking from the ANC-led Knysna Municipality that they would not be paying any further monies to Sotshede and Loliwe. Despite threatening urgent legal action, the Municipality simply refused to respond and refused to confirm that they would not be making payment to the officials.
After taking legal advice, ActionSA decided that, instead of proceeding with an urgent application which would only address 7 days’ worth of salary, we would rather pursue the recovery of all remuneration paid as a consequence of the unlawful resolutions taken by the Knysna Council. The total irregular expenditure incurred amounts to approximately R1 million.
ActionSA has therefore requested the Knysna Municipal Manager to initiate the process in accordance with Knysna Municipality’s Unauthorised, Irregular, Fruitless and Wasteful Policy to ensure that the recovery of the irregular expenditure serves before the next meeting of the Municipal Public Accounts Committee (MPAC) scheduled for July 2023.
ActionSA will monitor whether the recovery of the unlawful remuneration will be on MPAC’s agenda at its next meeting and, if not, we have reserved our right to take the necessary legal action.
