Failure of Gupta’s Extradition Request Sign of SA’s Declining International Standing

ActionSA is extremely disappointed in the United Arab Emirates’ (UAE) rejection of South Africa’s request to surrender Atul and Rajesh Gupta to stand trial for state capture-related crimes.

The Gupta duo is implicated in crimes which cost the South African government over R250 billion, and billions more in lost economic growth and lost jobs, and it is therefore welcomed that the Justice Ministry will be appealing the decision by UAE courts.

The news that UAE courts already rejected the request at the beginning of February, but our Justice Ministry was only informed this week, furthermore, supports ActionSA’s view that South Africa has lost the respect of the international community.

It is extremely concerning that South African diplomats in the UAE – who are paid to advance the country’s interests – failed to duly follow the court proceedings, engage with their UAE counterparts and keep the South African government updated.

Both Justice Minister, Ronald Lamola, and International Relations Minister, Naledi Pandor, have difficult questions to answer in this regard.

South Africa and the ANC’s conflicting international relations policy are contributing factors in the UAE’s failure to treat the matter with the severity it deserves.

ActionSA also questions how the ANC-led government allowed and possibly assisted the Gupta family to exit South Africa after allegations of their involvement in state capture first started to emerge.

This after the ANC enabled the Gupta family and their associates to steal billions from state coffers, and again the ANC’s policies will allow the Gupta family to get away with these crimes.

ActionSA, a party committed to the rule of law, will not allow this injustice to occur and will speak to our legal teams to ensure that the Gupta’s are brought to justice for the crimes they committed against the South African people.
