ActionSA Rejects DA’s Misrepresentation Of Forensic Report & Ongoing Abuse Of Due Process

ActionSA notes the Democratic Alliance’s decision today to lay criminal charges against the Deputy Executive Mayor of Tshwane, Cllr Eugene Modise, following the tabling of the forensic investigation report before Council last week.

This antic reflects a continuation of the DA’s pattern of misrepresenting facts that are not supported by the report and attempting to turn a serious matter into a political weapon.

The DA is presenting allegations as if they are confirmed findings. This is misleading. The forensic investigation did not make findings of corruption. It focused on disclosure obligations under the Code of Conduct for Councillors. These issues must be dealt with through the established legal and procedural mechanisms of Council, not through political commentary that seeks to distort what the report actually says.

The DA’s decision to lay charges of fraud further illustrates this distortion. Fraud is a specific criminal offence that requires deliberate misrepresentation, unlawful intent and verified prejudice. The forensic report made no such finding. For the DA to pursue criminal charges on a basis not supported by the report demonstrates clear political opportunism rather than a genuine interest in accountability.

Council has already taken the correct step of referring the report to a committee for formal consideration. This process exists to ensure that the matter is handled with the seriousness it deserves, in a lawful, fair and procedurally sound manner. It is only through this route that Council can reach conclusions that are credible and defensible.

ActionSA has no interest in shielding any individual from accountability and does not speak for the ANC – a party with whom we have voiced strong opposition against countless acts of wrongdoing over the years. Our commitment is to ensure that accountability is achieved through transparent, lawful and responsible mechanisms that uphold the integrity of Council.

Tshwane residents deserve outcomes based on verified facts and proper process, not accusations crafted to generate political controversy by a political party that is desperate to create the appearance of this government looking the other way from wrongdoing in order to deflect from its unrivalled legacy of failure in the city.

The administration under Executive Mayor Dr Nasiphi Moya remains focused on restoring service delivery, strengthening governance and rebuilding the City of Tshwane.

ActionSA will not be diverted by political theatrics that undermine due process and mislead residents and we call upon those interested in the truth and facts to call out the dishonest theatrics of the DA.
